Who is responsible for paying the Transfer Fee to Floors To Go during a transfer?

You or the transferee(s) shall pay to us the Transfer Fee; and
Two representatives of the transferee(s) shall attend a two-day training program at our headquarters in Bonita Springs, Florida prior to our consent to transfer.
We will reimburse transferee(s) for all reasonable costs relating to travel and lodging incurred by the two representatives for their attendance at this two-day program.

What This Means (2025 FDD)
According to the 2025 Floors To Go Franchise Disclosure Document, in the event of a transfer of a franchise agreement, either the franchisee (you) or the new transferee is responsible for paying the transfer fee to Floors To Go. Additionally, two representatives from the transferee's side must attend a two-day training program at Floors To Go headquarters in Bonita Springs, Florida, before the transfer can be approved. Floors To Go will cover the reasonable travel and lodging costs for these two representatives during the training program.
This means that if you decide to sell your Floors To Go franchise, you and the potential buyer will need to agree on who will cover the transfer fee. This fee is in addition to any other costs associated with the sale, such as legal and brokerage fees. The requirement for the transferee's representatives to attend training ensures that the new ownership is properly trained in the Floors To Go system. The fact that Floors To Go covers the travel and lodging costs for this training is a benefit for the transferee.
It is important to note that the transfer is not automatically approved. Floors To Go has 60 days after notification to either approve or disapprove the proposed transferee. If Floors To Go fails to respond within this timeframe, the transfer is considered approved. Upon approval, the transferee assumes the remaining term of the transferor's membership agreement, and subsequent renewals are subject to the terms of a new agreement with the transferee. Also, upon approval of the transfer, Floors To Go is released from any claims the transferor may have against them.
