What This Means (2025 FDD)

According to the 2025 Floors To Go Franchise Disclosure Document, Floors To Go states that they will protect and maintain all rights to the name and mark "Floors To Go" and all related names, marks, or logos against encroachment, misuse, or unauthorized use and against challenges to any rights of your use, as they determine in their sole discretion.

Floors To Go emphasizes the importance of its intellectual property rights in its name. Franchisees are not permitted to contest Floors To Go's ownership or rights to use its trade names, trademarks, service marks, trade secrets, methods, procedures, or advertising techniques. The franchisee's use of Floors To Go's marks, including "Floors To Go and design" and "Floors To Go Your Hometown Flooring Center and design," benefits Floors To Go exclusively. Franchisees acknowledge that all rights to these marks, including trademark, design, patent, and copyright rights, are reserved to Floors To Go.

To further protect its trademarks, Floors To Go may seek trademark protection for its marks at its own expense, and franchisees cannot seek or acquire any interest in these marks. Franchisees must also cooperate with Floors To Go in any filings related to trademark protection. Additionally, franchisees are required to report any infringement of the Floors To Go name or mark to Floors To Go, which then has the sole discretion to take action.

However, it's important to note that the Minnesota Amendment alters this provision for franchisees in Minnesota. In Minnesota, Floors To Go is only required to protect and maintain these rights to the extent required by Minnesota Statutes §80C.12, Subd. 1(g).
