What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, franchisees must only use names specifically authorized in writing by Fitstop for operating their franchised business. This means a franchisee cannot choose any name they want.
This restriction is in place to maintain brand consistency and protect Fitstop's proprietary marks. The FDD also states that all directory listings, letterheads, and any other visual or printed matter used to communicate with anyone must conform to Fitstop's brand standards and manuals. This ensures that all aspects of the business's presentation align with the established brand identity.
This requirement is typical in franchising, as franchisors need to maintain a consistent brand image across all locations. A prospective Fitstop franchisee should clarify with Fitstop what names are pre-approved and understand the process for requesting approval for alternative names, if any. This will help ensure compliance and avoid potential conflicts.
Failure to adhere to these naming and branding guidelines could result in a breach of the franchise agreement. Therefore, it is crucial for franchisees to follow Fitstop's instructions and obtain written authorization for any names used in the operation of the franchised business.
