What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop has the authority to require franchisees to stop using advertising or marketing materials, even those Fitstop previously approved. This requirement must be communicated to the franchisee in writing.
This means that even if a Fitstop franchisee invests time and money into creating advertising materials that Fitstop initially approves, Fitstop can later mandate that the franchisee cease using those materials. This could be due to a change in brand strategy, a shift in marketing focus, or other reasons determined by Fitstop. The franchisee would then need to discontinue using the previously approved materials.
This clause gives Fitstop significant control over the marketing and advertising efforts of its franchisees, ensuring brand consistency and allowing Fitstop to adapt its marketing strategies as needed. However, it also introduces a risk for franchisees, who may have to abandon marketing materials and strategies that they have already invested in, potentially incurring additional costs to develop new materials.
