What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop has the right to modify the range of services offered by franchisees. Fitstop can add to or delete a service from the range of services by providing written notice to the franchisee or by amending the Manual(s). This action must be reasonably necessary to protect or promote the parties' legitimate commercial interest. If a service is deleted, the franchisee must immediately stop offering or providing it.
This clause gives Fitstop considerable flexibility to adapt the service offerings in response to market changes, competitive pressures, or evolving consumer preferences. For a franchisee, this means the services they initially offer may not be the same throughout the term of the franchise agreement. It is important to stay updated on any written notices or amendments to the Manuals to ensure compliance.
While Fitstop has the right to make these changes, it must be reasonably necessary to protect or promote the commercial interests of both parties. This implies that Fitstop cannot make arbitrary changes that would negatively impact the franchisee's business without a valid reason. Franchisees should pay close attention to any proposed changes and seek clarification from Fitstop if they are unclear about the reasons or potential impact of the changes. Understanding the conditions under which Fitstop can modify service offerings is crucial for franchisees to effectively manage their business and adapt to changes in the market.
