Under what condition would a State-Specific Addendum be included in the Fitstop FDD?
Fitstop Franchise · 2024 FDDAnswer from 2024 FDD Document
As part of our current standard offering, we expect and intend to award you a geographical area wherein: (i) you must locate and secure an approved Premises; and (ii) we will afford you certain territorial rights as disclosed more fully in Item 12 of this Disclosure Document (your "Designated Territory"). Once you secure an approved Premises within that Designated Territory within the timeline set forth in your Franchise Agreement, we may mutually agree to amend the boundaries of the Designated Territory in a separately-signed addendum to provide territorial rights within the area that immediately surrounds the actual Premises where the Franchised Business is being operated.

What This Means (2024 FDD)
Based on the 2024 Fitstop Franchise Disclosure Document, a State-Specific Addendum would be included if the franchisee and Fitstop mutually agree to amend the boundaries of the Designated Territory. This amendment would occur after the franchisee secures an approved premises within their Designated Territory and aims to provide territorial rights within the area immediately surrounding the actual premises where the Fitstop franchise is operated.
This addendum serves to formalize any adjustments to the franchisee's territory, ensuring that their territorial rights are clearly defined in relation to their physical location. It protects both the franchisee and Fitstop by establishing a written agreement that outlines the specific area in which the franchisee has exclusive or protected rights.
For a prospective Fitstop franchisee, this means that the initial Designated Territory outlined in the Franchise Agreement may be subject to change based on the location of the approved premises. The franchisee should carefully review the terms of the addendum to fully understand the scope of their territorial rights and any limitations that may apply. It is important to note that the addendum requires mutual agreement, so the franchisee has the opportunity to negotiate the terms of the territorial rights with Fitstop.
