What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, franchisees are generally prohibited from disclosing information in the Manual(s) to any person without Fitstop's prior written consent. However, there is an exception: franchisees may disclose information from the Manual(s) to employees of the Fitstop franchise. This disclosure is only permitted if it is for purposes directly related to the operation of the franchise.
This means a Fitstop franchisee can share relevant parts of the Manual(s) with their staff to ensure they understand and follow the correct procedures for running the business. However, the franchisee cannot share the Manual(s) with outside parties, such as consultants or other business owners, without first obtaining written permission from Fitstop.
Additionally, the Fitstop franchisee cannot reprint or reproduce the Manual(s), either in whole or in part, for any reason other than instructing employees in how to operate the franchise. This restriction is in place to protect Fitstop's confidential trade secrets and maintain control over its operating procedures. The franchisee must also ensure that employees are aware that the information in the Manuals remains Fitstop's property.
This policy is typical in franchising, as franchisors need to protect their proprietary information to maintain a competitive advantage and ensure consistency across all franchise locations. Prospective Fitstop franchisees should understand these restrictions and ensure they have a system in place to manage access to the Manual(s) and other confidential information.
