What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, if a franchisee wishes to transfer their franchise, they must sign a general release and other documents that Fitstop requires. This is one of several conditions that must be met for Fitstop to approve the transfer.
Other conditions include being in full compliance with the Franchise Agreement and paying all amounts due to Fitstop. The transferee and its managers must also satisfactorily complete Fitstop's training program and execute the then-current form of the Franchise Agreement. Additionally, either the franchisee or the transferee must pay a transfer fee, and Fitstop must approve all written agreements regarding the transfer.
The franchisee must also supply Fitstop with any additional information they reasonably require regarding the transfer. Furthermore, the franchisee must provide a personal covenant to the transferee, agreeing not to divert business from Fitstop or its franchisees. This comprehensive set of requirements ensures that Fitstop maintains control over who operates its franchises and that the transfer process is conducted in a way that protects the brand and its existing franchisees.
