Your Franchised Business must always be managed and staffed with at least one (1) individual who has successfully completed the components of the Initial Training Program associated with being an owner/operator or, if appropriate, Designated Manager. In the event you develop more than one (1) System
franchise, you must have a properly trained Designated Manager at each Franchised Business you have the right to own and operate (but are not serving as its on-site manager).
In addition to the Franchise Agreement, both you and your spouse will be required to sign guarantees of performance in which you will guarantee the performance of the Franchisee entity's obligations to us under that agreement. The only restriction we place on the manager of your business is that the manager must execute a confidentiality and non-competition agreement similar to the one you will execute if you purchase a franchise from us.

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, each Fitstop franchise must have at least one individual who has successfully completed the Initial Training Program. This individual can be the owner/operator or a Designated Manager. If the franchisee chooses not to be the full-time operator, they must engage a Designated Manager who completes the training program.
This requirement ensures that every Fitstop location has someone on-site who is properly trained in the Fitstop system. If a franchisee owns multiple Fitstop locations, each location must have a trained Designated Manager if the franchisee is not the on-site manager. The Designated Manager does not need to have an equity interest in the franchise.
If a Designated Manager leaves, the franchisee has 30 days to recruit a replacement and submit their qualifications to Fitstop for review and approval. This approval may depend on the candidate meeting certain "Management Criteria." This process ensures that a qualified, trained individual is always managing the Fitstop location. The Designated Manager must also sign a Confidentiality and Non-Competition Agreement.
