2.1 Franchise Award; Approved Premises. We award you the right, and you undertake and accept the obligation, to independently own and operate the Franchised Business from the location you propose, we approve and you secure in accordance with the terms of this Agreement (the "Premises"). You
acknowledge that the rights granted in this Agreement only award you the right to: (i) operate the Franchised Business in accordance with our System standards and specifications from the specific Premises that we approve in writing; and (ii) market, advertise and promote the Franchised Business within the geographical area we designate in Schedule 2 to this Agreement (your "Designated Territory"). The Premises, once approved by us and secured by you, will be set forth in the Data Sheet attached as Schedule 1 to this Agreement (the "Data Sheet").

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, the specific location, or "Premises", of the franchised business will be documented in the Data Sheet, which is attached as Schedule 1 to the Franchise Agreement. The Franchise Agreement grants the franchisee the right to operate their Fitstop business from this approved location, provided it meets Fitstop's System standards and specifications.
Fitstop must approve the franchisee's proposed location in writing before it can be secured. The rights granted to the franchisee are limited to operating the business from this specific Premises and marketing within the Designated Territory, which is defined in Schedule 2 of the Franchise Agreement. Franchisees are restricted to providing services and products only at and from the approved Premises, unless Fitstop provides separate written consent.
During the term of the Franchise Agreement, Fitstop agrees not to operate or license another System Business under its Proprietary Marks from a physical location within the franchisee's Designated Territory. However, this territorial protection is subject to certain rights reserved by Fitstop. The franchisee must also adhere to specific requirements regarding the build-out of the Premises, including providing plans for Fitstop's consent, engaging licensed contractors, securing appropriate insurance, and ensuring compliance with all specified requirements and regulations.
Fitstop requires that the Premises be used exclusively for operating the Franchise and kept open to the public during specified hours. Any changes to the Premises must receive Fitstop's prior written consent. Franchisees are also prohibited from installing vending machines, gaming machines, or other equipment at the Premises without Fitstop's approval.
