- 9.5.3.10 ensure that you pay any and all amounts due in connection with the buildout and other development activities associated with establishing the Franchised Business at the Premises, which may include amounts due to our Approved Supplier(s) and/or us.

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, the franchisee is responsible for paying all amounts due in connection with the build-out and other development activities associated with establishing the franchised business at the premises. This includes amounts due to Fitstop's approved suppliers or directly to Fitstop.
Fitstop requires the franchisee to manage, supervise, and ensure the build-out is completed by competent, licensed tradesmen in a proper and workmanlike manner. The franchisee must also secure appropriate insurances in connection with the build-out and correct any defects. Compliance with all requirements specified in the manuals and government regulatory requirements must also be verified by the franchisee.
Fitstop may, at its discretion, organize the build-out of the premises, but regardless of who undertakes the build-out, Fitstop is entitled to review, approve, and confirm the design and build-out. The franchisee must pay Fitstop for any reasonable project design and site approval fees upon demand. The franchisee is responsible for ensuring the premises complies with all system standards and specifications, including the design, layout, furniture, fixtures, equipment, and other required items designated in the manuals.
