- 1.2 Each System Business is authorized to operate (a) under the then-current proprietary marks, logos, associated taglines, names and/or trade dress that we designate now or in the future, including our current primary mark FITSTOP® (collectively, the "Proprietary Marks"), and (b) the system that we and our affiliates have developed for use in connection with the establishment of a System Business (the "System").

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, a Fitstop System Business is authorized to operate under the Proprietary Marks that the company designates. These marks include the current primary mark FITSTOP®, along with any other proprietary marks, logos, associated taglines, names, and/or trade dress that Fitstop designates now or in the future.
This means that as a franchisee, you are granted the right to use Fitstop's brand identity to operate your fitness facility. However, this authorization is subject to Fitstop's control and modifications. Fitstop retains the right to change these Proprietary Marks, and franchisees must adhere to any updates or changes made by Fitstop.
It is important to note that franchisees must use the Proprietary Marks in compliance with the franchise agreement, the Fitstop System, and the Manuals. Franchisees are prohibited from taking any actions that could interfere with Fitstop's Marks and IP, including applying for registration or protection of similar items without prior written consent. Franchisees must also notify Fitstop of any infringement claims related to the use of the Marks and IP.
