Are the 'Proprietary Marks' for Fitstop limited to just the FITSTOP® mark?

Fitstop USA, Inc. is the franchisor. To simplify matters, this document will refer to the franchisor as "we," "us," or "our." "Franchisee", "you" or "your" means the company which buys the franchise, including company's owners, partners, controlling shareholders, officers, guarantors, and managers, if any. If the owners, partners, controlling shareholders, officers, or guarantors are married and your spouse is not an owner, partner, controlling shareholder, officer, or guarantor of the franchise business, certain provisions of our Franchise Agreement will also apply to your spouse.
We incorporated in Delaware on July 22, 2022. Our principal business address is 2260 S. Centinela Ave., Suite 150, Los Angeles, CA 90064. We conduct business under our corporate name and under the primary mark FITSTOP®, as well as any and all other marks, logos, designs and names that we designate for licensing as part of our franchise system from time to time (collectively, the "Proprietary Marks").

According to Fitstop's 2024 Franchise Disclosure Document, the 'Proprietary Marks' include more than just the FITSTOP® mark. Fitstop USA, Inc. conducts business under its corporate name and the primary mark FITSTOP®, but also uses "any and all other marks, logos, designs and names that we designate for licensing as part of our franchise system from time to time" which are collectively referred to as the "Proprietary Marks".
This means that as a Fitstop franchisee, you are not only authorized to use the FITSTOP® trademark but also any other marks, logos, designs, and names that Fitstop designates for licensing within its franchise system. This gives Fitstop the flexibility to introduce new branding elements or trademarks that franchisees can use to promote their businesses.
Prospective franchisees should be aware that Fitstop retains the right to modify or add to the Proprietary Marks. It is important to stay updated on any changes or additions to these marks, as franchisees are required to use the designated Proprietary Marks in their business operations and marketing materials. Understanding the full scope of the Proprietary Marks and any associated guidelines is crucial for maintaining brand consistency and complying with the franchise agreement.
