  • 12.4.5 Pricing Policies. You shall comply with any pricing policies and guidelines which we reasonably notify you of from time to time and we are lawfully able to impose including policies under which we specify a maximum price for the Approved Products or services. Where reasonably necessary to protect our legitimate commercial interest, we may change our recommended or maximum retail prices, charges, discounts relating to or affecting any of the Approved Products or services and issue new or changed or modified recommended or maximum price lists upon notice.
  • 12.4.6 Rebates. You acknowledge that we may negotiate and/or receive rebates or other financial incentives from the manufacturers and suppliers of any Required Items and/or Approved Products that a System franchisee must acquire and/or offer for sale at the Premises or otherwise in connection with the Franchised Business. You agree that we may retain for our own benefit all rebates or payments received from any Approved Suppliers and/or other providers/suppliers, whether or not such rebates or payments are made as a consequence of purchases by you.
  • 12.4.7 Proposal to Use Alternate Sources of Supply. If you wish to purchase supplies from an alternative supplier, you must deliver to us a sample of each item of supplies proposed to be purchased from the alternative supplier. We may check those items to ensure that they are of an appropriate quality for the Franchise. We may notify you if any of the items are unsuitable for the Franchise in which case you must not use such supplies in the Franchise. We will use our best efforts to ensure that either we or a designated supplier will at all times have a supply of Approved Products for sale to you.

Based on the 2024 Fitstop Franchise Disclosure Document, the brand will reasonably notify franchisees of pricing policies and guidelines from time to time. Fitstop may change its recommended or maximum retail prices, charges, and discounts relating to any approved products or services. They will issue new, changed, or modified recommended or maximum price lists upon notice.

Fitstop may request franchisees to install and use specific telephone and other communication systems, including point-of-sale hardware and software, for the franchise's operation if requested in writing. Franchisees may also be required to change or upgrade any telephone and communications systems that Fitstop considers obsolete, including installing new systems specified by them. Franchisees must ensure that all telephone and communications systems are secure from unauthorized access or use.

Fitstop may require franchisees to purchase computer hardware or license software specified by them directly from them or, subject to law, from certain Approved Suppliers. This includes installing and using computer hardware and software that satisfies the functionality and specification requirements specified by Fitstop. Franchisees must acquire and maintain software licenses for all Required Software, whether covered by the Technology Fee or otherwise.
