What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop franchisees must adhere to several guidelines regarding personal information. If a franchisee becomes aware of any unauthorized use, copying, or disclosure of personal information, or if legally required to disclose personal information, they must notify Fitstop immediately. Franchisees must also comply with any reasonable written directions from Fitstop to protect personal information from unauthorized access or use, or to take actions Fitstop deems necessary to comply with privacy laws.
Fitstop requires franchisees to obtain all necessary consents from individuals providing personal information, ensuring compliance with obligations related to data protection. Franchisees are instructed to collect member information as specified in Fitstop's manuals or in writing, and only in the manner prescribed by Fitstop. Storing member information in external documents or databases is prohibited, and franchisees must provide all member information to Fitstop in the specified format at the end of each calendar month or within 24 hours of a written request.
These measures ensure that Fitstop maintains control over member data and can enforce consistent privacy practices across all franchise locations. The franchise agreement emphasizes that member information is Fitstop's property, allowing them to establish and maintain a member database. Franchisees must also keep the required software, CMS, and associated hardware secure from unauthorized use and ensure that these tools are used only for their authorized purpose, without modification or reverse engineering. This includes complying with all reasonable requirements related to the use of required software and the CMS, as directed by Fitstop.
