What This Means (2024 FDD)
According to the 2024 Fitstop FDD, franchisees are prohibited from certain actions on social media that could harm the Fitstop brand. Specifically, franchisees must adhere to Fitstop's social media policy as detailed in the manuals. Any social media activity not conforming to these manuals requires prior written approval from Fitstop.
Fitstop franchisees must comply with Fitstop's directions regarding social media activity. If a franchisee is directed to remove social media content and fails to do so, they authorize Fitstop to remove the content themselves. Franchisees are explicitly prohibited from disparaging Fitstop or any of its other franchisees on social media. Additionally, franchisees must not post anything that brings harm or disrepute to the Fitstop franchise system.
Failure to comply with these social media guidelines constitutes a material breach of the Franchise Agreement. This means that Fitstop can take action against the franchisee, potentially including termination of the agreement, if the franchisee's social media activity is deemed harmful to the brand. This is a fairly standard clause in franchise agreements, as franchisors need to protect their brand reputation and image.
