Fitstop Franchise · 2024 FDD

Answer from 2024 FDD Document

Your grant of a Franchised Business does not include: (i) any right to offer any services via e-commerce except through a website designated by us; (ii) any right to establish an independent website or to establish a URL incorporating the Proprietary Marks or any variation thereof; or (iii) any right to distribute, market, or implement our services in any channel of distribution not specifically identified in the Franchise Agreement.

You will be obligated to offer and sell any new or replacement products and/or services we designate, and you must participate in all local, regional and promotional program initiatives and campaigns adopted by us in which we require you to participate. We have the right to designate which of our franchisees may, or will be required to, participate in new product or service tests, new or modified product or service offerings and other programs and initiatives that we may, from time to time, develop. If we designate you for participation in any such program, initiative or campaign, you must participate when and as required by us. There are no limits on rights to require you to offer and sell those new products or to participate in those programs, initiatives and campaigns.

What This Means (2024 FDD)

According to Fitstop's 2024 Franchise Disclosure Document, a franchisee's right to distribute, market, or implement services is restricted to channels specifically identified in the Franchise Agreement. Franchisees cannot offer services via e-commerce except through a website designated by Fitstop. Additionally, franchisees are prohibited from establishing an independent website or using a URL that incorporates Fitstop's proprietary marks.

This means that Fitstop franchisees are limited in how they can market and sell their services. They must adhere to the distribution channels outlined in their agreement and cannot independently create online platforms or websites to promote their Fitstop business, ensuring a consistent brand image and controlled marketing strategy across all locations.

Fitstop retains the authority to introduce new products and services, and franchisees are obligated to offer and sell these designated items. Franchisees must also participate in local, regional, and promotional programs initiated by Fitstop. Fitstop also has the right to select franchisees for participation in tests, new offerings, and other programs, and participation is mandatory when required by Fitstop. This allows Fitstop to maintain uniformity and quality control across its franchise network, but it also means franchisees have limited autonomy in choosing which products or programs they want to offer.

This level of control is common in franchising, where franchisors seek to maintain brand consistency and quality. However, prospective Fitstop franchisees should carefully review the Franchise Agreement to understand the specific distribution channels they are permitted to use and the extent of their obligations to participate in new programs and initiatives.
