What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, if Fitstop sends representatives to visit the franchisee's premises, the franchisee must be present during these visits if requested with prior notice. The franchisee is required to fully cooperate with Fitstop personnel during these visits. This includes making available any information, reports, accounts, books, records, orders, receipts, statements, and other information that Fitstop requests. Additionally, the franchisee must allow Fitstop to access the franchise's computers and computer records. These visits will occur during normal business hours at the franchise location, unless both parties agree otherwise.
Fitstop also has the right to visit, inspect, observe, and report on the operation of the franchised business, with or without notice to the franchisee, at times and frequencies determined by Fitstop. The franchisee must ensure that their employees fully cooperate with Fitstop representatives during these visits. The franchisee agrees to provide any evidence requested by Fitstop to assure compliance with the Fitstop Franchise System and to cooperate with any evaluation programs implemented by Fitstop.
These requirements mean that a Fitstop franchisee must maintain organized and accessible records, ensure their staff is trained to cooperate with Fitstop representatives, and be prepared to dedicate time to these visits. Failure to comply with these requirements could be considered a breach of the franchise agreement and may lead to penalties or termination of the agreement. This level of oversight is common in franchising, as it helps the franchisor maintain brand standards and ensure consistent operations across all locations.
