Fitstop Franchise · 2024 FDD

Answer from 2024 FDD Document

Your grant of a Franchised Business does not include: (i) any right to offer any services via e-commerce except through a website designated by us; (ii) any right to establish an independent website or to establish a URL incorporating the Proprietary Marks or any variation thereof; or (iii) any right to distribute, market, or implement our services in any channel of distribution not specifically identified in the Franchise Agreement.

You will be obligated to offer and sell any new or replacement products and/or services we designate, and you must participate in all local, regional and promotional program initiatives and campaigns adopted by us in which we require you to participate. We have the right to designate which of our franchisees may, or will be required to, participate in new product or service tests, new or modified product or service offerings and other programs and initiatives that we may, from time to time, develop. If we designate you for participation in any such program, initiative or campaign, you must participate when and as required by us. There are no limits on rights to require you to offer and sell those new products or to participate in those programs, initiatives and campaigns.

What This Means (2024 FDD)

According to Fitstop's 2024 Franchise Disclosure Document, franchisees are not granted the right to offer services via e-commerce, except through a website designated by Fitstop. Additionally, franchisees do not have the right to establish an independent website or a URL that incorporates Fitstop's proprietary marks. They also cannot distribute, market, or implement services through any distribution channel not specifically identified in the Franchise Agreement.

This restriction means that a Fitstop franchisee's online presence and e-commerce activities are controlled by the franchisor. Franchisees must use the website designated by Fitstop for any online sales or service offerings. This ensures brand consistency and allows Fitstop to manage the online customer experience. However, it also limits the franchisee's autonomy in developing their own online marketing strategies.

Fitstop retains the right to designate which franchisees participate in new product or service tests, offerings, and other programs. If a franchisee is selected for such participation, they are obligated to comply with Fitstop's requirements. This allows Fitstop to test new initiatives and maintain uniformity across the franchise system. Franchisees should be prepared to adapt to changes and participate in these programs as directed by Fitstop.

These stipulations are typical in many franchise systems, where franchisors aim to maintain brand control and consistency. Prospective Fitstop franchisees should carefully consider these restrictions and understand the extent to which their online activities and service offerings are governed by the franchisor.
