What This Means (2024 FDD)

According to Fitstop's 2024 Franchise Disclosure Document, the franchise agreement specifies that valuable consideration provided to the franchisee includes the Manual(s). Specifically, the agreement states that Fitstop will provide valuable consideration that includes items such as the use of the Franchise System, Manual(s), specialized training, and Confidential Information. This valuable consideration is in exchange for the franchisee's agreement to certain covenants, including in-term covenants against competition.

This means that as a Fitstop franchisee, you are receiving the right to use Fitstop's established system, training programs, and confidential information, all of which are documented in the Manual(s). The Manual(s) are considered part of the valuable consideration that Fitstop provides to you under the franchise agreement. This is a fairly standard practice in franchising, as the franchisor's knowledge and systems are key assets.

The franchisee's access to the Fitstop Manual(s) is not without conditions. The franchisee is obligated to protect the confidential information contained within the Manual(s). They can only disclose the Competitive Information to employees for purposes related to the operation of the franchise. The franchisee is also prohibited from reprinting or reproducing the Competitive Information, except in connection with instruction of employees in the operation of the Franchise.

Overall, the inclusion of the Manual(s) as part of the valuable consideration highlights their importance in the Fitstop franchise system. Prospective franchisees should carefully review the contents of the Manual(s) during their due diligence to fully understand the operational requirements and expectations of the franchise.
