Your Franchise Agreement does not provide you with any right of first refusal, option or any other rights to acquire additional franchises.
Your Franchise Agreement does not provide you with any right or option to open and operate any additional Franchised Businesses. As previously discussed, each Franchised Business you are awarded the right to open and operate must be governed by its own specific form of Franchise Agreement unless we agree to add that subsequent franchise to your existing agreement via a form of addendum. We have not established other franchised or company-owned outlets or another distribution channel for offering or selling products/services that are similar to the Approved Products and Approved Services under a different trademark. Neither we nor our affiliates have established, or presently intend to establish, other franchised or company-owned businesses that sell our Approved Products and Approved Services under a different trade name or trademark, but we reserve the right to do so in the future without your consent.

According to Fitstop's 2024 Franchise Disclosure Document, the Franchise Agreement does not provide franchisees with any right of first refusal, option, or any other rights to acquire additional franchises. Each Fitstop franchise that a franchisee is awarded the right to open and operate must be governed by its own specific Franchise Agreement, unless Fitstop agrees to add that subsequent franchise to the existing agreement via an addendum.
This means that if a Fitstop franchisee wants to open additional locations, they cannot assume they have any special advantage or guaranteed opportunity to do so. They will essentially be treated as a new applicant for each additional franchise unless Fitstop agrees otherwise. Furthermore, Fitstop retains the right to establish other franchised or company-owned outlets or another distribution channel for offering or selling products/services that are similar to the Approved Products and Approved Services under a different trademark. Fitstop also states that they do not have any intention to establish other franchised or company-owned businesses that sell their Approved Products and Approved Services under a different trade name or trademark, but they reserve the right to do so in the future without franchisee consent.
Prospective Fitstop franchisees should be aware that their initial investment does not guarantee future expansion opportunities and that Fitstop retains significant control over the growth and development of the franchise system. It would be prudent for potential franchisees to discuss their long-term growth aspirations with Fitstop during the due diligence process to understand the franchisor's criteria and processes for awarding additional franchises.
