- 9.9.4 You acknowledge and agree that: (1) compliance with this section is at your sole cost and expense; (2) it is in the best interests of both parties that the Franchise be open for trade from the new Premises as soon as possible; and (3) subject to relevant laws, the new Premises are to be fitted out at your cost to conform with the then prevailing image and otherwise in accordance with this Section.

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, if a franchisee relocates their Fitstop business, the new premises must conform to the brand's prevailing image and other standards. The franchisee is responsible for the costs associated with fitting out the new location to meet these standards. Fitstop's approval is required for the new premises.
Fitstop retains the right to modify the System's standards through manuals or written notice. This includes requiring upgrades to the premises, furniture, fixtures, equipment, or other required items. Franchisees are responsible for performing these upgrades at their own cost within 180 calendar days of notification, ensuring the new location aligns with the current brand standards.
Prior to opening at the new location, Fitstop must confirm in writing that the premises have been properly erected or converted and improved with equipment and furnishings that meet their specifications. Additionally, the franchisee must obtain all necessary consents for operating the Fitstop business from the new premises. This ensures that the relocated Fitstop business maintains the brand's image and operational standards.
