What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop will display the contact information of a franchisee's Fitstop business on its website. This is done to advertise and promote the Fitstop brand, its proprietary marks, and other franchised business locations. However, this is contingent upon the franchisee adhering to the terms outlined in the Franchise Agreement.
Fitstop also retains the right to discontinue the operation of the website at any time without prior notice to the franchisee. Furthermore, Fitstop may require franchisees to maintain and utilize a specific email account for their franchised business. Franchisees are restricted from establishing or operating any website, web page, domain name, or online presence that discusses or alludes to Fitstop, the System, or their franchised business without obtaining written consent from Fitstop.
Subject to the terms of the Franchise Agreement and Operations Manual, Fitstop may make available to franchisees a sub-page on the Website that will be located at a subdomain of the Website to be specified by them. Franchisees will be permitted to upload content onto the Subpage solely to promote and provide customers with information related to their Franchised Business. The franchisee may only upload content onto the Subpage in accordance with terms of the Franchise Agreement and any guidelines, directives or specifications issued by Fitstop. The Subpage may not contain content which references any other Franchised Businesses other than the franchisee's Franchised Business. The franchisee may not upload, publish, display, or otherwise include or use any content on the Subpage without receiving Fitstop's approval. Once Fitstop approves the initial content of the Subpage, the franchisee must submit any changes to them before making any changes. Fitstop may, at any time, cease to make the Subpage available to the franchisee or the public.
These stipulations are fairly typical in franchising, as franchisors need to maintain brand control and consistency across all locations. Prospective Fitstop franchisees should carefully review the terms of the Franchise Agreement and Operations Manual to fully understand their obligations and restrictions regarding online presence and marketing.
