What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop has the authority to approve advertising materials. Specifically, franchisees must use only the signs, posters, and other advertising materials that Fitstop approves. Fitstop also retains the right to remove any unapproved materials from the premises. This ensures brand consistency and adherence to Fitstop's standards across all franchise locations.
This requirement extends to social media activity. Any social media activity proposed by a franchisee that does not conform to the guidelines in Fitstop's Manual(s) must receive written approval from Fitstop in advance. Fitstop can direct a franchisee to remove non-approved social media content, and if the franchisee fails to do so, Fitstop is authorized to remove the content itself. Franchisees are prohibited from disparaging Fitstop or other franchisees on social media, or posting anything that could harm the reputation of the Fitstop franchise system.
Fitstop also has the discretion to adopt advertising plans or materials and use them for their own benefit or share them with other franchisees. Furthermore, Fitstop will make staff available for consultation on advertising and promotion, as they determine appropriate. This allows Fitstop to maintain control over its brand image and marketing strategies while providing support and guidance to franchisees.
These stipulations are typical in franchising, as they allow the franchisor to maintain brand consistency and protect the overall reputation of the franchise system. For a prospective Fitstop franchisee, this means they must adhere to Fitstop's marketing guidelines and obtain approval for any advertising materials or social media activities that deviate from the established standards.
