We have expended and continue to expend significant time and resources developing in connection with the Franchise System certain brand standards, confidential information, and know-how relating to the administration and operation of a franchised businesses including all systems, processes, procedures, software, databases, logos, manuals, advertising information and promotional materials ("Confidential Information").

What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Confidential Information is defined to include advertising information and promotional materials. Fitstop has expended significant time and resources developing brand standards, confidential information, and know-how relating to the administration and operation of a franchised business, including systems, processes, procedures, software, databases, logos, manuals, advertising information, and promotional materials, all of which are considered Confidential Information.
This means that as a Fitstop franchisee, you are obligated to protect and maintain the confidentiality of Fitstop's advertising plans, methods, and promotional materials. You cannot disclose this information to any person without prior written consent from Fitstop, except to employees of the franchise for purposes related solely to the operation of the franchise. You also cannot reprint or reproduce any Confidential Information provided to you, in whole or in part, for any purpose except in connection with instruction of employees in the operation of the Franchise.
Fitstop also states that they own all proprietary rights to the Confidential Information in its entirety and that the Confidential Information constitutes their confidential trade secrets. This underscores the importance of keeping such information secure and only using it as authorized by Fitstop. Failure to comply with these confidentiality obligations could result in legal action from Fitstop.
