In addition to the other obligations in this section, you will certify to us on an annual basis and by a date advised by us, that you are in compliance with all applicable workplace laws. If it comes to our attention, through an audit or otherwise, that there are systematic or substantial fraudulent activities on your part (such as falsifying pay records provided to us and/or an employee or fraudulently representing the minimum pay rates to an employee), we reserve our rights to terminate this Agreement for cause on the basis that you have acted fraudulently in connection with the operation of the Franchise.

What This Means (2024 FDD)

The Fitstop 2024 Franchise Disclosure Document states that franchisees must certify compliance with all applicable workplace laws to Fitstop on an annual basis. This certification must be completed by a date that Fitstop advises. If Fitstop discovers systematic or substantial fraudulent activities, such as falsifying pay records or misrepresenting minimum pay rates, it reserves the right to terminate the Franchise Agreement for cause.

This requirement ensures that Fitstop franchisees adhere to legal and ethical standards in their employment practices. By requiring annual certification, Fitstop aims to maintain a consistent level of compliance across all franchise locations. The potential for termination due to fraudulent activities underscores the importance of accurate record-keeping and ethical conduct in the operation of the franchise.

Prospective Fitstop franchisees should be aware of this annual certification requirement and the potential consequences of non-compliance. They should ensure they have systems in place to accurately track and manage payroll and employee entitlements. Additionally, franchisees should maintain open communication with Fitstop regarding any employment-related issues or concerns to avoid potential misunderstandings or disputes.

While the FDD specifies the annual certification of compliance with workplace laws, it does not explicitly detail the exact format, content, or specific documentation required for this certification. It is important for potential franchisees to seek clarification from Fitstop regarding the specific requirements for the annual compliance certification to ensure they meet all obligations.
