What This Means (2024 FDD)

According to Fitstop's 2024 Franchise Disclosure Document, Fitstop does not currently have any specific ongoing maintenance or support contract requirements, aside from working with their third-party Approved Supplier for billing/collection and related services. However, Fitstop franchisees may spend between $500 and $1,500 annually on updates and maintenance to the Computer System hardware, including any non-material upgrades.

Fitstop may require updates and upgrades to the Computer System and/or Required Software during the franchise term. These updates to hardware, software, and other Computer System components are at the franchisee's expense, with reasonable advance notice, typically 60 or more days, provided via the Manuals or in writing. The FDD specifies that there are no contractual limitations to the frequency and cost of the obligation to upgrade and maintain these items.

Franchisees are also responsible for investigating and ensuring compliance with all payment card industry (PCI) and data security standard (DSS) standards, regulations, and requirements, including using required tools, systems, and vendors to complete ongoing PCI requirements like quarterly external security scans and annual self-assessment questionnaires. The franchisee is solely responsible for all costs relating to PCI compliance and data security issues, such as security threats, breaches, and malware. Franchisees must alert Fitstop within 24 hours following a suspected or confirmed data security breach.
