What This Means (2024 FDD)
According to Fitstop's 2024 Franchise Disclosure Document, Fitstop must approve written agreements regarding the transfer of a franchise. This is one of several conditions that must be met for Fitstop to approve a transfer.
Other conditions include the franchisee being in full compliance with their Franchise Agreement and paying all amounts due to Fitstop. Additionally, the person or entity to whom the franchise is being transferred (the transferee) and their managers must satisfactorily complete Fitstop's training program. The transferee must also execute Fitstop's then-current form of Franchise Agreement, and either the franchisee or the transferee must pay a transfer fee.
Furthermore, the franchisee must supply Fitstop with any additional information they reasonably require regarding the transfer. The franchisee must also provide a personal covenant to the transferee, agreeing not to divert business from Fitstop or its franchisees. Finally, the franchisee must sign a general release and any other documents Fitstop requires.
