Answer from 2025 FDD Document

  • v. Franchisee acknowledges and agrees that certain associations between its FAT SHACK Restaurant, the Marks, and/or the FSI franchise system, on the one side, and a political (including a political party or candidate), religious, social, cultural or similar group, member, cause, and/or activities (collectively, a "Political or Social Cause"), on the other side, may result in adverse publicity and other adverse impacts on the Marks and/or franchise system with certain segments of the public. As such, Franchisee agrees that it will not, without FSI's prior written consent, make any statement or take any other action (including posting signs) that could be perceived as promoting, approving, disapproving, publicizing, or otherwise commenting on a Political or Social Cause in any manner that is connected to or associated with the FAT SHACK Restaurant, the Marks, and/or the FSI franchise system.

What This Means (2025 FDD)

According to Fat Shack's 2025 Franchise Disclosure Document, a franchisee is restricted from making statements or taking actions related to a Political or Social Cause if those statements or actions are connected to or associated with the Fat Shack restaurant, the brand's trademarks, or the franchise system itself, and lack prior written consent from Fat Shack Inc. This includes any action that could be perceived as promoting, approving, disapproving, publicizing, or otherwise commenting on a Political or Social Cause.

This restriction is in place because Fat Shack believes that certain associations between the brand and political, religious, social, cultural, or similar groups could lead to adverse publicity and negatively impact the brand's reputation among certain segments of the public. Therefore, Fat Shack aims to control any messaging that could be attributed to the brand in relation to these sensitive topics.

For a prospective Fat Shack franchisee, this means that engaging in any form of advocacy or commentary on Political or Social Causes through their Fat Shack restaurant or in association with the brand requires explicit approval from the franchisor. Failure to obtain this consent could result in a breach of the franchise agreement and potential repercussions. This policy highlights the importance of aligning personal views with the brand's image and adhering to the franchisor's guidelines on public statements and actions.
