What This Means (2025 FDD)
According to the 2025 Fat Shack Franchise Disclosure Document, the last page of the document is a detachable receipt that the prospective franchisee must sign, date, and deliver to Fat Shack. This action must be completed at least 14 calendar days before the signing of the Franchise Agreement or payment of any fee. Attachment N contains a copy of the receipt for the franchisee's records, preceding the copy that must be signed and returned to Fat Shack.
This requirement ensures that the franchisee acknowledges receipt of the FDD and has had sufficient time to review it before making any binding commitments or payments. The 14-day period is mandated by federal law to protect franchisees from being pressured into signing agreements without proper consideration. Some states, like New York, Iowa and Michigan, have different timelines for providing the disclosure document, so franchisees should be aware of the laws in their specific state.
By signing the receipt, the franchisee confirms they have received the FDD, but it's also an acknowledgement of several important factors. These include the dates of meetings, receipt of documents, and understanding of the risks involved in the franchise. The franchisee also acknowledges that Fat Shack has advised them to seek independent professional advice and to discuss the franchise with existing franchisees. This receipt serves as a record that Fat Shack has fulfilled its legal obligations in providing the necessary information to the franchisee.
