What This Means (2025 FDD)

According to Fat Shack's 2025 Franchise Disclosure Document, Fat Shack offers assistance related to site acceptance for a restaurant location. However, the franchisee is responsible for selecting and acquiring the site. Fat Shack's minimum assistance includes providing general criteria for a satisfactory site and determining whether a proposed site meets these criteria before formal acceptance. Fat Shack bases its approval on information submitted by the franchisee, ensuring they can properly assess the proposed location.

This means that while Fat Shack provides guidelines and evaluates the site, the franchisee bears the primary responsibility for finding and securing a suitable location. The franchisee must gather and submit all necessary information for Fat Shack to review. Fat Shack's approval is based solely on the information provided and does not guarantee the site's success or profitability.

It is important for prospective Fat Shack franchisees to understand that Fat Shack is not obligated to provide additional site selection services unless specified in a separate written agreement. Franchisees should conduct thorough due diligence on potential locations and not rely solely on Fat Shack's approval as a guarantee of success. This is a fairly typical arrangement in the franchise industry, where the franchisee usually handles site selection with franchisor guidance.
