What This Means (2025 FDD)

According to Fat Shack's 2025 Franchise Disclosure Document, franchisees are granted the right to use specific 'Licensed Methods' in operating their Fat Shack restaurant. These methods encompass the distinctive plan for establishing, operating, and promoting Fat Shack restaurants. This includes recipes, menu items, food and beverage preparation techniques, technical restaurant equipment standards, customer relations strategies, marketing techniques, written promotional materials, Operations Manual contents, advertising approaches, and accounting systems. Fat Shack considers all of these elements to be trade secrets.

Fat Shack franchisees must use these Licensed Methods in accordance with the standards and systems that Fat Shack develops and prescribes. Franchisees are expected to operate all aspects of their Fat Shack restaurant using these methods. This ensures uniformity and consistency across all Fat Shack locations, maintaining the brand's identity and quality.

While franchisees have the right to use these Licensed Methods, they do not acquire any ownership or title to them. Fat Shack retains full control and ownership, including any innovations, additions, or improvements made to the Licensed Methods, even if those improvements are developed by the franchisee. This underscores the importance of adhering to Fat Shack's established systems and procedures, as well as the brand's control over its operational standards and intellectual property.
