What This Means (2025 FDD)

According to the 2025 Fat Shack FDD, if the Washington Rider is checked as an "Applicable Rider", then that rider is incorporated into the Nondisclosure and Noncompetition Agreement. The terms of the Applicable Rider will supersede the terms of the Nondisclosure and Noncompetition Agreement to the extent that there are any conflicts.

Fat Shack includes riders to the Franchise Agreement for specific states and provinces as Exhibit VI. Additionally, Fat Shack includes riders to the Nondisclosure and Noncompetition Agreement for specific states and provinces.

Prospective franchisees should carefully review Exhibit VI and the Nondisclosure and Noncompetition Agreement to determine if the Washington Rider applies to their franchise agreement. If the Washington Rider is marked as applicable, franchisees operating in Washington must adhere to its specific terms, which may modify or supersede the standard terms of the franchise agreement and the Nondisclosure and Noncompetition Agreement.
