What This Means (2025 FDD)
According to Fat Shack's 2025 Franchise Disclosure Document, a franchisee is generally prohibited from operating any other business or profession from or through the Fat Shack Restaurant. This restriction is in place to ensure that the franchisee's focus remains solely on the Fat Shack business and to maintain the brand's standards and reputation.
However, there is an exception to this rule. If the franchisee is an entity, it may operate another business in addition to the Fat Shack Restaurant, but only if the franchisee obtains prior written approval from Fat Shack Inc. (FSI). This provision allows for some flexibility, particularly for franchisees who may have existing business interests or wish to diversify their business activities.
This requirement underscores the importance of seeking explicit permission from Fat Shack before engaging in any other business ventures connected to the Fat Shack Restaurant. Failing to obtain this approval could result in a breach of the franchise agreement. Prospective franchisees should discuss any potential conflicts of interest or plans to operate other businesses with Fat Shack during the due diligence process to ensure compliance and avoid future complications.
