Under the Franchise Agreement, you personally (or, if you are not an individual, your managing owner) or your General Manager must devote full time and best efforts to managing and operating your FAT SHACK Restaurant on a day-to-day basis, and you (or your managing owner) and you or your General Manager must successfully complete our mandatory training program. Although we recommend it, you (or your managing owner) need not participate personally in the day-to-day operations of your FAT SHACK Restaurant's, although you (or your managing owner) must be actively involved in the business operations, such as overseeing payroll, employee meetings, and other business oversight. In that case, however, your General Manager must manage your FAT SHACK Restaurant's daily operations.

What This Means (2025 FDD)

According to Fat Shack's 2025 Franchise Disclosure Document, the franchisee, or if the franchisee is not an individual, the managing owner, must devote full time and best efforts to managing and operating the Fat Shack Restaurant on a day-to-day basis. They must also successfully complete Fat Shack's mandatory training program. However, the franchisee or managing owner is not required to participate personally in the day-to-day operations, but they must be actively involved in the business operations, such as overseeing payroll, employee meetings, and other business oversight.

If the franchisee or managing owner does not participate personally in the day-to-day operations, a General Manager must manage the Fat Shack Restaurant's daily operations. The franchisee must ensure that either they (or their Managing Owner) or a General Manager who has completed the initial training program will be responsible for the management of the Fat Shack Restaurant after commencement of operations and be present at the Restaurant Location during operation of the Fat Shack Restaurant.

For franchisees that are corporations, limited liability companies, partnerships, or other entities, Fat Shack does not require the General Manager to own an equity interest in the company. However, the General Manager, other employees, and all officers, directors, partners, shareholders, and members (and, if the franchisee is an individual, their spouse) must agree to be bound by the nondisclosure and noncompetition provisions of the Franchise Agreement.
