What This Means (2025 FDD)

According to the 2025 Fat Shack Franchise Disclosure Document, a franchisee is explicitly restricted from using the restaurant location for any purpose other than operating a Fat Shack Restaurant. The franchise agreement specifies that during and after the term of the agreement, neither the franchisee nor their successors can use the restaurant location for anything other than running the Fat Shack business. This restriction is further reinforced by the requirement that franchisees must only sell products and services approved by Fat Shack and operate all aspects of the restaurant in accordance with the franchisor's prescribed methods.

This limitation means a Fat Shack franchisee cannot operate any other business or profession from or through the Fat Shack Restaurant location. If the franchisee is an entity, that entity's sole purpose must be to operate the Fat Shack Restaurant, unless prior written approval is obtained from Fat Shack. This ensures that the franchisee's focus remains entirely on the Fat Shack business and maintains the brand's consistency and standards.

These stipulations are common in franchising to protect the brand and ensure uniformity across all locations. By preventing franchisees from engaging in other business activities at the Fat Shack location, the franchisor can maintain control over the brand image and customer experience. Prospective franchisees should carefully consider these restrictions and ensure they are comfortable dedicating the restaurant location exclusively to the Fat Shack business.
