If, as of the date you sign your Franchise Agreement, you do not have the Restaurant Location chosen and approved by us, we will designate, by Addendum to the Franchise Agreement, a "Target Area" within which to find a Restaurant Location. The designation of the Target Area does not in any manner grant you any continuing territorial rights in or to the Target Area. If the Addendum lists only a Target Area and not the Restaurant Location, then we and you will sign the Restaurant Location Supplement to Franchise Agreement attached as Exhibit II to the Franchise Agreement upon our later approval of the Restaurant Location.

What This Means (2025 FDD)
According to Fat Shack's 2025 Franchise Disclosure Document, a 'Target Area' is designated by Fat Shack in an addendum to the Franchise Agreement if the franchisee has not yet chosen and had approved a restaurant location as of the date of signing the agreement. This Target Area serves as a preliminary area within which the franchisee is expected to find a suitable restaurant location.
It is important to note that the designation of a Target Area does not grant the franchisee any exclusive or continuing territorial rights within that area. The franchisee's rights are contingent upon finding and securing an approved Restaurant Location within the Target Area. Once a location is approved, a Restaurant Location Supplement to the Franchise Agreement is signed, superseding the initial Target Area designation.
This arrangement benefits both Fat Shack and the franchisee. It allows the franchisee to begin the initial stages of the franchising process without a specific location, while still providing a geographic focus for their search. However, prospective franchisees should understand that the Target Area is only a temporary designation and does not guarantee any territorial protection or exclusivity until a Restaurant Location is approved and a Protected Territory is defined around that location.
