What This Means (2025 FDD)
According to Fat Shack's 2025 Franchise Disclosure Document, Fat Shack retains the right to use and license alternative proprietary marks or methods in connection with operating other businesses. These businesses can operate under names that are not the same as or confusingly similar to the Fat Shack marks. These businesses may be the same as, similar to, or different from Fat Shack Restaurants.
This means that Fat Shack has the freedom to explore different business ventures, even those related to the restaurant industry, without being restricted by the Fat Shack brand. They can create entirely new brands and operating methods, offering products and services that may or may not overlap with those of a typical Fat Shack franchise.
For a prospective franchisee, this clause indicates that Fat Shack is not limited to just the Fat Shack concept. They could potentially introduce competing brands or alternative business models that might draw customers away from existing Fat Shack locations. While these new ventures would operate under different names and marks, they could still impact a franchisee's market share and profitability. Franchisees should consider this possibility and inquire about Fat Shack's long-term business development plans to understand the potential competitive landscape.
