FAP Fees or other mall-specific advertising obligations imposed pursuant to the Lease, and such amounts shall be in addition to the costs of Local Advertising.

  • (b) Franchise Advertising Program. In addition to the Local Advertising obligations under Section 4.3(a), Franchisee shall participate in Franchisor's franchise advertising program (the "FAP") by paying to Franchisor a continuing monthly fee (the "FAP Fee"). No later than the 10th day of each month during the Term, Franchisee shall pay Franchisor the FAP Fee for the prior month. The FAP Fee shall be equal to the latest amount specified by Franchisor and may increase from time to time as a result of an increase in Franchisor's advertising costs. The FAP Fee currently is $150 per month for a Kiosk or $175 per month for an Inline Store. We may increase the FAP Fee on an annual basis, but the total increase will not exceed 15% per year.
