Without our prior written consent, you may not conduct sales activities outside your Territory. What This Means (2025 FDD)

According to Face Foundrie's 2025 Franchise Disclosure Document, a franchisee is restricted from conducting sales activities outside their designated territory without prior written consent from Face Foundrie. This restriction extends to any Facial Bar activities conducted outside the physical premises of the approved location, unless Face Foundrie provides written approval. Additionally, franchisees are prohibited from utilizing other distribution channels, such as the Internet, catalog sales, telemarketing, or other direct marketing methods, to solicit sales outside their territory.

This policy has significant implications for Face Foundrie franchisees, as it limits their ability to expand their customer base beyond their immediate geographic area through various sales and marketing tactics. While the franchise agreement grants the right to operate a Facial Bar at a specific location, it also imposes restrictions on how and where franchisees can conduct sales activities. This means that franchisees must rely primarily on local marketing efforts and in-store sales to generate revenue, potentially limiting their growth potential compared to franchises with fewer territorial restrictions.

However, Face Foundrie and its affiliates retain the right to operate businesses, including Facial Bars, that may be similar to or different from those found in franchised locations, both within and outside the franchisee's territory. They can also sell products identified with the Face Foundrie marks through any distribution channel, except through the operation of a Facial Bar. This includes sales through catalogs, e-commerce, and retail chains, even if those channels operate within a franchisee's territory. This reservation of rights allows Face Foundrie to pursue various business opportunities and distribution strategies without being restricted by franchisee territories, potentially creating competition for franchisees within their own territories.

Prospective Face Foundrie franchisees should carefully consider these territorial restrictions and the potential for competition from Face Foundrie's other business ventures. It is important to understand the specific boundaries of the territory, the demographic characteristics of the area, and the potential for overlap with other Face Foundrie distribution channels. Additionally, franchisees should inquire about Face Foundrie's plans for future expansion and distribution strategies to assess the potential impact on their business.
