Who selects the mediation date if Face Foundrie and the Area Developer cannot agree?

According to Face Foundrie's 2025 Franchise Disclosure Document, if the Area Developer and Face Foundrie cannot agree on a date for mediation, the mediation organization will select a date it believes is reasonable for both parties, considering all claimed conflicts in dates.

This means that after a notice to mediate has been sent, and an independent mediation entity has been selected, that organization will schedule the mediation at a time convenient for both parties. However, if both parties cannot agree on a date, the mediation organization will step in to select a date they deem reasonable.
