3. DEVELOPMENT OF THE FACIAL BAR.
- 3.01 Site Selection. Franchisee acknowledges that, other than providing its criteria for site approval for the Facial Bar, Franchisor provides no site-selection assistance.
To that end, Franchisor will not visit the search area and Franchisee will be responsible to identify, and ultimately acquire, an appropriate site, acceptable to Franchisor, for the Facial Bar's operation.

What This Means (2025 FDD)
According to Face Foundrie's 2025 Franchise Disclosure Document, Section 3.01 of the Franchise Agreement pertains to site selection. Specifically, it states that Face Foundrie provides its criteria for site approval but offers no direct site-selection assistance. The franchisee is responsible for identifying and acquiring a site acceptable to Face Foundrie for the Facial Bar's operation.
Item 11 of the FDD also mentions site selection under the Franchise Agreement, stating that Face Foundrie will work with the franchisee to determine a mutually acceptable territory for the Facial Bar. The franchisee selects the site, but it is subject to Face Foundrie's acceptance. The proposed site may be leased or owned by the franchisee, as Face Foundrie generally does not own the premises. Face Foundrie's approval is based on information provided by the franchisee, including site plans, square footage, traffic patterns, demographics, costs, zoning, surrounding facilities, lease terms, and distance from competitors.
Furthermore, the franchisee must submit proposed site and construction plans for approval, and construction must meet Face Foundrie's specifications. If the premises are leased, the lease must include a Lease Rider in a form acceptable to Face Foundrie. If Face Foundrie does not approve a site, the franchisee must propose a new one. Failure to agree on a site may result in termination of the Franchise Agreement. Once a site is approved, the franchisee is responsible for conforming the premises to local ordinances and building codes and for overseeing construction according to Face Foundrie's standards.
