Does Face Foundrie have the right to designate suppliers of design and/or architecture services?

Franchisor shall have the right to designate one or more suppliers of design services and/or architecture services to supply such services to the System.

If Franchisor designates a design firm and/or architecture firm prior to the time Franchisee commences to develop the Facial Bar, Franchisee shall employ such designated supplier(s) to prepare all designs and plans for the Facial Bar, unless Franchisee obtains Franchisor's prior written approval to use an alternative professional.

If Franchisor has not designated a design firm or architecture firm, Franchisee shall be responsible for locating and employing a qualified design consultant and architect who is/are licensed in the jurisdiction in which the Facial Bar will be located, and who is reputable and experienced in providing design and architecture services.

Franchisee shall be solely responsible for payments for all design and architecture services.

Franchisee expressly acknowledges and agrees that Franchisor shall not be liable for the unsatisfactory performance of any contractor, firm, supplier, professional or consultant retained by Franchisee, whether or not designated by Franchisor.

According to Face Foundrie's 2025 Franchise Disclosure Document, Face Foundrie has the right to designate suppliers of design and/or architecture services for franchisees. Specifically, Face Foundrie can designate one or more suppliers to provide these services to the franchise system. If Face Foundrie designates a firm before a franchisee begins developing their Facial Bar, the franchisee is required to use the designated supplier for all designs and plans, unless they receive prior written approval from Face Foundrie to use an alternative professional.

If Face Foundrie has not designated a specific design or architecture firm, the franchisee is responsible for finding and hiring a qualified design consultant and architect. These professionals must be licensed in the jurisdiction where the Facial Bar will be located and have a good reputation and experience in providing these services. Regardless of whether the supplier is designated by Face Foundrie or chosen by the franchisee, the franchisee is solely responsible for all payments for design and architecture services.

Face Foundrie explicitly states that it will not be liable for any unsatisfactory performance by any contractor, firm, supplier, professional, or consultant retained by the franchisee. This holds true whether or not the entity was designated by Face Foundrie. This means that franchisees bear the risk of poor performance by these service providers, even if those providers were recommended or required by the franchisor.
