What is Face Foundrie not responsible for regarding the operation of a Franchised Facial Bar at a particular site?
Face_Foundrie Franchise · 2025 FDDAnswer from 2025 FDD Document
Area Developer acknowledges and agrees Franchisor will not be responsible for Area Developer's results in operating at any particular site that Franchisor may have recommended, reviewed, or approved.
- 3.2.3 Area Developer hereby acknowledges and agrees that approval by Franchisor of a site does not constitute an assurance, representation, or warranty of any kind, express or implied, as to the suitability of the site for the Franchised Facial Bar or for any other purpose.
Approval by Franchisor of the site indicates only that Franchisor believes the site complies with acceptable minimum criteria established by Franchisor solely for its purposes as of the time of the evaluation.
Both Area Developer and Franchisor acknowledge that application of criteria that have been effective with respect to other sites and premises may not be predictive of potential for all sites and that, subsequent to approval by Franchisor of a site, demographic and/or economic factors, such as competition from other similar businesses, included in or excluded from criteria used by Franchisor could change, thereby altering the potential of a site.
Such factors are unpredictable and are beyond the control of Franchisor.
Franchisor shall not be responsible for the failure of a site approved by Franchisor to meet Area Developer's expectations as to revenue or operational criteria.

What This Means (2025 FDD)
According to Face Foundrie's 2025 Franchise Disclosure Document, Face Foundrie is not responsible for the success or failure of a franchisee's location. While Face Foundrie provides site selection criteria and may review potential sites, the document explicitly states that Face Foundrie will not be responsible for the franchisee's results in operating at any particular site, even if Face Foundrie recommended, reviewed, or approved it.
Face Foundrie's approval of a site does not guarantee the site's suitability for the Franchised Facial Bar or any other purpose. The approval only indicates that the site meets Face Foundrie's minimum criteria at the time of evaluation. Demographic and economic factors can change after the approval, which could alter the site's potential. These factors are unpredictable and beyond Face Foundrie's control.
This means that while Face Foundrie offers guidance during the site selection process, the ultimate responsibility for choosing a viable location rests with the franchisee. The franchisee bears the risk if a site approved by Face Foundrie fails to meet revenue or operational expectations. This is a common arrangement in franchising, where franchisees typically bear the location risk while benefiting from the franchisor's brand and system.
