Franchisee expressly acknowledges and agrees that Franchisor shall not be liable for the unsatisfactory performance of any contractor, firm, supplier, professional or consultant retained by Franchisee, whether or not designated by Franchisor.

According to Face Foundrie's 2025 Franchise Disclosure Document, the franchisee is solely responsible for payments for all design and architecture services related to the development of their Facial Bar. This means that the franchisee will bear the full financial burden of these services.

Before starting construction, Face Foundrie requires the franchisee to comply with certain requirements to the Franchisor's satisfaction. Face Foundrie will provide a sample layout and décor specifications. The franchisee must then employ a qualified, licensed architect or engineer approved or designated by Face Foundrie to prepare preliminary plans and specifications for site improvement or construction, based on prototype plans provided by Face Foundrie.

Face Foundrie retains the right to designate suppliers of design and/or architecture services. If Face Foundrie designates a firm, the franchisee must use that firm unless they obtain prior written approval from Face Foundrie to use an alternative professional. However, even if Face Foundrie designates a firm, the franchisee remains responsible for paying for those services. This ensures that the design and construction align with Face Foundrie's brand standards, but the franchisee bears the cost and the risk of unsatisfactory performance by any contractor or consultant they retain, even if designated by Face Foundrie.
