What This Means (2025 FDD)
According to Face Foundrie's 2025 Franchise Disclosure Document, Face Foundrie does reserve the right to require franchisees to discontinue the use of previously approved advertising, promotional, sales, or marketing materials. This means that even if a franchisee has received prior approval for specific marketing content, Face Foundrie can later mandate that the franchisee cease using those materials.
This provision gives Face Foundrie significant control over the brand's image and marketing strategies. It allows them to ensure consistency and adapt to changing market conditions or brand standards. For a franchisee, this means they must be prepared to update or replace their marketing materials if directed by Face Foundrie, even if those materials were previously approved. This could involve additional costs for new materials and potential disruptions to ongoing marketing campaigns.
Furthermore, the FDD states that any materials a franchisee requests Face Foundrie to create or submits for review become the property of Face Foundrie, with no restrictions on their use or distribution of these materials. Face Foundrie also requires franchisees to include specific language in their local marketing materials, such as "Franchises Available" and their website address, telephone number, social media icons and addresses. Franchisees must also participate in any other promotional and advertising programs that Face Foundrie establishes.
Given this level of control, it is crucial for prospective Face Foundrie franchisees to carefully review the advertising and marketing sections of the Franchise Agreement and Operations Manual. Understanding the specific circumstances under which Face Foundrie might require changes to marketing materials, and the process for obtaining approval for new materials, is essential for managing marketing costs and ensuring compliance with Face Foundrie's standards.
