- Amendments. Tenant agrees that the Lease may not be terminated, modified or amended without Franchisor's prior written consent, nor shall Landlord accept surrender of the Premises without Franchisor's prior written consent. Tenant agrees to promptly provide Franchisor with copies of all proposed modifications or amendments and true and correct copies of the signed modifications and amendments.

What This Means (2025 FDD)
According to the 2025 Face Foundrie Franchise Disclosure Document, the tenant, or franchisee, is required to obtain prior written consent from Face Foundrie before the landlord can accept surrender of the premises. This stipulation is put in place to protect Face Foundrie's interest in the location and ensure that the lease terms align with the franchise agreement.
This requirement means that a Face Foundrie franchisee cannot simply relinquish the property back to the landlord without first getting approval from Face Foundrie. This gives Face Foundrie control over the location, allowing them to potentially find another franchisee for the site or ensure the premises are properly vacated and branded according to their standards.
The franchisee is obligated to provide Face Foundrie with copies of any proposed modifications or amendments to the lease, as well as copies of the signed modifications and amendments. This ensures Face Foundrie is kept informed of any changes to the lease agreement and can exercise its rights as a third-party beneficiary to enforce the lease terms.
