Does Face Foundrie choose the site for my Facial Bar location?

We do not choose the site but you will be given site criteria based on the existing facial bars.
The site must meet these criteria, which may include demographic characteristics, traffic patterns, parking, character of neighborhood, competition from proximity to and the nature of other businesses, size, appearance, and other physical and commercial characteristics, unless we otherwise approve your site.
You must submit to us all information and other data about the proposed Facial Bar site that we reasonably request.
You cannot operate a Facial Bar without our inspection and acceptance of the site for the Facial Bar. (Section 3.01 of the Franchise Agreement)
Before you sign your Franchise Agreement, we will work with you to determine a Territory (described in Item 12) for your Facial Bar that is mutually acceptable. You select the site for your Facial Bar, subject to our acceptance.
The site for your Facial Bar may be leased or owned by you, and we generally do not own the premises and lease them to you. The proposed site for your Facial Bar must be accepted by us along with any applicable lease, sublease or purchase agreement. Our approval of a site will be based on the information you give us to review, including a site plan. The information should include: (i) square footage; (ii) traffic patterns, flow, and total count; (iii) density and income level of the surrounding population; (iv) land and building costs; (v) zoning patterns; (vi) surrounding educational and recreational facilities; (vii) terms of the lease, if any; (viii) the distance
from competitive businesses, including other facial bars; and (ix) other factors having a substantial bearing on the proposed site. In addition, you must submit for acceptance by us proposed site and construction plans and any modification to our specifications you propose. The construction of the premises must be completed according to our specifications. If you lease the premises, you and the landlord must enter into a lease reasonably acceptable to us, which includes the Lease Rider in substantially the form attached to the Franchise Agreement (currently as Exhibit G). If we do not approve a site, you must propose a new site. If we and you are unable to agree upon a site for your Facial Bar and, as a result, you fail to meet required opening date, we may terminate your Franchise Agreement. Once we have all the necessary documentation for review, we typically review that information and approve or disapprove the proposed site and lease within 30 days. Once we have approved a site, it is your responsibility to conform the premises to local ordinances and building codes, and to obtain any required permits.
Under the Area Development Agreement: Before you open the Facial Bar:
- (a) We will approve or deny your proposed site for each Facial Bar. (Area Development Agreement, Section 3.2)

What This Means (2025 FDD)
According to Face Foundrie's 2025 Franchise Disclosure Document, the franchisee is responsible for selecting the site for their Facial Bar, although this selection is subject to Face Foundrie's final approval. Face Foundrie does not choose the site for the franchisee. However, Face Foundrie will provide the franchisee with site criteria based on existing facial bars to aid in the selection process.
Before the Franchise Agreement is signed, Face Foundrie will collaborate with the franchisee to determine a mutually agreeable territory for the Facial Bar. The franchisee then proposes a site, which Face Foundrie must accept. The FDD outlines several factors that Face Foundrie will consider during the site approval process. These include the site's square footage, traffic patterns, population density and income levels in the surrounding area, land and building costs, zoning patterns, proximity to educational and recreational facilities, lease terms, and distance from competitors.
The franchisee must also submit proposed site and construction plans to Face Foundrie for approval, and construction must adhere to Face Foundrie's specifications. If the premises are leased, the lease agreement must include a Lease Rider in a form acceptable to Face Foundrie. If Face Foundrie disapproves a proposed site, the franchisee must propose a new one. Failure to secure an approved site, which results in missing the required opening date, may lead to termination of the Franchise Agreement. Face Foundrie typically reviews and approves or disapproves a proposed site and lease within 30 days of receiving all necessary documentation.
Once a site is approved, the franchisee is responsible for ensuring the premises comply with local ordinances and building codes and for obtaining any required permits. The franchisee also oversees the construction, remodeling, and decorating of the premises, following Face Foundrie's standards and guidelines. For each proposed site under an Area Development Agreement, the franchisee must also obtain Face Foundrie's approval, as outlined in the FDD. Face Foundrie will be deemed to have disapproved a location unless expressly approved in writing.
