What does approval by Face Foundrie of a site indicate?
Face_Foundrie Franchise · 2025 FDDAnswer from 2025 FDD Document
- 3.2.3 Area Developer hereby acknowledges and agrees that approval by Franchisor of a site does not constitute an assurance, representation, or warranty of any kind, express or implied, as to the suitability of the site for the Franchised Facial Bar or for any other purpose.
Approval by Franchisor of the site indicates only that Franchisor believes the site complies with acceptable minimum criteria established by Franchisor solely for its purposes as of the time of the evaluation.
Both Area Developer and Franchisor acknowledge that application of criteria that have been effective with respect to other sites and premises may not be predictive of potential for all sites and that, subsequent to approval by Franchisor of a site, demographic and/or economic factors, such as competition from other similar businesses, included in or excluded from criteria used by Franchisor could change, thereby altering the potential of a site.
Such factors are unpredictable and are beyond the control of Franchisor.
Franchisor shall not be responsible for the failure of a site approved by Franchisor to meet Area Developer's expectations as to revenue or operational criteria.

What This Means (2025 FDD)
According to the 2025 Face Foundrie FDD, approval of a site by Face Foundrie does not guarantee the site's suitability for a franchised facial bar or any other purpose. Instead, it signifies that Face Foundrie believes the site meets the minimum criteria established by them at the time of evaluation. This approval is based on Face Foundrie's standards and is intended for their internal purposes.
Face Foundrie emphasizes that the criteria used for site approval may not accurately predict the potential of all sites. Demographic and economic factors, such as competition, can change after the site's approval, affecting its potential. These factors are unpredictable and beyond Face Foundrie's control. Therefore, Face Foundrie is not liable if an approved site fails to meet the area developer's expectations regarding revenue or operational criteria.
In practical terms, this means that while Face Foundrie provides site selection guidelines and may offer counseling, the area developer is ultimately responsible for identifying and securing a suitable location. The area developer also acknowledges that Face Foundrie is not responsible for the financial performance of the location, even if Face Foundrie recommended, reviewed, or approved the site. The area developer is expected to conduct their own independent investigation to determine if the location is suitable for their business goals.
