What does Face Foundrie's approval of a site NOT constitute regarding the suitability of the site?
Face_Foundrie Franchise · 2025 FDDAnswer from 2025 FDD Document
- 3.2.3 Area Developer hereby acknowledges and agrees that approval by Franchisor of a site does not constitute an assurance, representation, or warranty of any kind, express or implied, as to the suitability of the site for the Franchised Facial Bar or for any other purpose.
Approval by Franchisor of the site indicates only that Franchisor believes the site complies with acceptable minimum criteria established by Franchisor solely for its purposes as of the time of the evaluation.
Both Area Developer and Franchisor acknowledge that application of criteria that have been effective with respect to other sites and premises may not be predictive of potential for all sites and that, subsequent to approval by Franchisor of a site, demographic and/or economic factors, such as competition from other similar businesses, included in or excluded from criteria used by Franchisor could change, thereby altering the potential of a site.
Such factors are unpredictable and are beyond the control of Franchisor.
Franchisor shall not be responsible for the failure of a site approved by Franchisor to meet Area Developer's expectations as to revenue or operational criteria.

What This Means (2025 FDD)
According to Face Foundrie's 2025 Franchise Disclosure Document, the franchisor's approval of a site does not provide any assurance, representation, or warranty about the site's suitability for a franchised facial bar or any other purpose. Face Foundrie's approval only indicates that the franchisor believes the site meets its minimum criteria at the time of evaluation. This means that while Face Foundrie offers site selection guidelines and assistance, the final decision and responsibility for the site's success rest with the area developer.
Face Foundrie emphasizes that the criteria used for site selection may not accurately predict the potential of all sites. Demographic and economic factors, such as competition, can change after the site's approval, affecting its potential. These factors are often unpredictable and beyond Face Foundrie's control. Therefore, Face Foundrie is not responsible if an approved site fails to meet the area developer's expectations regarding revenue or operational criteria.
This disclaimer highlights the importance of conducting thorough due diligence on any potential site. Prospective Face Foundrie franchisees should not rely solely on the franchisor's approval but should also conduct their own market research and analysis to determine the site's viability. This includes assessing local demographics, competition, and economic conditions to ensure the site aligns with their business goals and revenue expectations. The Area Developer Certification further emphasizes that the franchisee's decision should be based on their independent investigation, not on any claims by Face Foundrie regarding potential sales or earnings.
